The following is intended to serve as a conversational springboard for discussion about the Ninth Circuit Bankruptcy Appellate Panel (the BAP).
The BAP hears intermediate bankruptcy appeals and writes for a variety of audiences: the parties, the Ninth Circuit (on review and generally), bankruptcy practitioners, and bankruptcy courts. For its part, the Ninth Circuit treats “the BAP’s decisions as persuasive authority given its special expertise in bankruptcy issues and to promote uniformity of bankruptcy law throughout the Ninth Circuit.“ In re Silverman, 616 F.3d 1001, 1005 n.1 (9th Cir. 2010).
